GENERAL RELEASE OF LIABILITY

LIABILITY WAIVER

Whereas the Client (Client defined as “any current or future client requesting services, attending events and retreats, or otherwise engaged in any activity conducted or hosted by Phoenix Healing Arts LLC dba Asia.Sikkila ” referred to hereinafter as “Client”) desires to hold harmless and indemnify the Company (Company defined as “Phoenix Healing Arts LLC dba Asia.Sikkila” referred to hereinafter as “Company”) from all liabilities, losses, claims, judgments, suits, fines, penalties, demands, or expenses that may result from the use of this website or from Company Services, Events, Retreats or Products.

Now, therefore, in consideration of the agreements set forth below, the parties hereby agree as follows:

INDEMNIFICATION AND HOLD HARMLESS

To the fullest extent of permitted by applicable law, the Client holds harmless and indemnifies the Company from any and all claims and actions arising out of the use or misuse of this website, contractual services, events, retreats, the use or purchase of products, coaching, or other Company offerings, without limitation, expenses, judgments, fines, settlements, and other amounts actually and reasonably incurred in connection with the use or misuse or this website and Company offerings. 

ASSUMPTION OF RISK

Use or misuse of this website and Company offerings carries with it inherent risks which could include personal and professional injury, security data breach, physical loss, emotional turmoil, psychological or spiritual pain or suffering, and other possible damages or injuries.

 

By choosing to use this website and engage or contract for services, events, retreats or other Company offerings, Client agrees they are fully aware of such risks and have sought full understanding of the possible consequences and hereby knowingly and voluntarily assume all risks of any nature, whether foreseeable or not.

SEVERABILITY

The Client further expressly agrees that the foregoing waiver of liability, assumption of risks and indemnity agreement is intended to be as broad and inclusive as permitted by the law of the State of Michigan and that if any portion thereof is held invalid it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

ACKNOWLEGEMENT OF UNDERSTANDING

By the use of this website and the contracting of services, events, retreats, or purchase of or engagement in any Company offerings, Client agrees to have read through this release of liability, assumption of risk, and indemnity agreement, and understands its terms and agrees to all such terms in its entirety.

 

Client also understands that this liability waiver is a base level waiver, provided by Company, as a first notice of release of liability and Company may, in its sole discretion, develop a more comprehensive liability waiver or hold harmless agreement that may be used during the contracting of service, attending of events and retreats, or engagement in any other COmpany offerings to establish a more comprehensive agreement to hold Company and all its subsidiaries, subcontractors, employees, and affiliates harmless.

The above mentioned hereto agrees to have read, understand, and accept this Agreement in its entirety.
